Terms of Service

SimplyTC provides a platform that connects real estate agents and brokers with transaction coordination services, including our Offer Desk, which assists with coordinating offers and transactions. We may add, change, or discontinue features of the Service at any time.

You must be at least 18 years old and a real estate professional (or acting on behalf of one) to use the Service. You are responsible for providing accurate information, for keeping your login credentials confidential, and for all activity that occurs under your account.

You consent to receive communications from us electronically, including by email, text message, and in-platform notifications, and you agree that electronic communications satisfy any legal requirement that such communications be in writing.

SimplyTC sends text messages related to your account and your real estate transactions. Our Offer Desk also corresponds with real estate agents by text message to coordinate offers and transactions on behalf of the agents and clients we serve.

How you opt in. You consent to receive these messages when you provide your mobile number and opt in — for example, by agreeing to these terms when you create an account, by giving us your mobile number, or by texting our Offer Desk first. Consent to receive text messages is not a condition of purchasing any goods or services.

Message types. Messages may include one-time verification codes, account and security alerts, transaction and offer status updates, coordination messages from your transaction coordinator or the Offer Desk, and service notifications. We do not send marketing or promotional text messages through this program.

• Message and data rates may apply.
• Reply STOP to any message to unsubscribe. Reply HELP for help. After you reply STOP, we send a single confirmation and will not send further messages unless you opt in again.

• Carriers are not liable for delayed or undelivered messages.

You agree not to:

• use the Service for any unlawful or fraudulent purpose;
• send abusive, harassing, or unsolicited marketing messages through the Service;
• attempt to gain unauthorized access to, disrupt, or scrape the Service; or
• misrepresent your identity or your authority to act in a transaction.

Certain features of the Service are provided for a fee. Fees, billing terms, and payment obligations are described in your applicable service agreement or order. You are responsible for all fees incurred under your account.

The Service and all associated software, content, and trademarks are owned by SimplyTC or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain ownership of the data you submit.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, SimplyTC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the Service.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
